These Terms of Service ("Terms") govern your access to and use of services provided by Automate My System ("AMS," "we," "us," or "our"), including our website, automation systems, check-in forms, and related software (collectively, the "Services"). By using our Services, signing an agreement with us, or submitting a deposit or payment, you agree to be bound by these Terms.
AMS designs, builds, and installs custom business automation systems for clients, including but not limited to client check-in systems, automated SMS messaging, review request automation, rebooking reminders, and related backend workflows. The specific scope of services for each client is defined in their individual onboarding agreement, proposal, or invoice.
Setup fees are due prior to the commencement of work unless otherwise agreed in writing. Monthly subscription fees are billed on a recurring basis and are due regardless of usage. Fees for third-party services used in connection with your system, including but not limited to SMS messaging platforms, are billed separately by those providers directly to you and are not included in fees paid to AMS.
Monthly plans are billed on a month-to-month basis with no long-term contract requirement, unless a different arrangement has been explicitly agreed to in writing. You may cancel your monthly service at any time; cancellation does not entitle you to a refund of the one-time setup fee or any prior month's payment.
Any custom code, automation workflows, templates, or systems built specifically for your business remain the property of AMS unless otherwise agreed in writing. You are granted a non-exclusive, non-transferable license to use the system we build for you for the duration of your active subscription. Upon cancellation, AMS reserves the right to disable or discontinue your access to hosted systems and automations.
Systems built by AMS may include automated SMS messaging functionality. You, as the client, are solely responsible for ensuring that your use of SMS messaging complies with all applicable laws, including obtaining proper consent from message recipients and honoring opt-out requests. AMS provides the technical infrastructure but does not control how you collect consent from your own customers, and AMS is not liable for your compliance with applicable messaging laws.
By providing your mobile number, you agree that the business you checked in with, using SimpleTexting, may send you periodic SMS or MMS messages containing but not limited to important information, updates, deals, and specials.

Though we will never charge you for the text messages you receive, depending on your phone plan, you may see some charges from your mobile provider. Please reach out to your wireless provider if you have questions about your text or data plan.
To the maximum extent permitted by law, AMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of or inability to use the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid to AMS in the preceding three months.
While we make reasonable efforts to keep your systems online and operational, AMS does not guarantee uninterrupted or error-free service. Systems depend in part on third-party platforms (including but not limited to Airtable, Zapier, SimpleTexting, and Calendly), and AMS is not responsible for outages or limitations caused by those third parties.
AMS reserves the right to suspend or terminate services to any client who violates these Terms, fails to pay applicable fees, or uses the Services for unlawful purposes. You may terminate your service at any time by providing written notice.
We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
